ElioFlow provides an AI-powered platform that allows users to generate, host, manage, and publish business websites.

Services may include:

• AI-generated website generation

• hosting

• domain connection

• subdomain hosting

• website regeneration

• customer contact forms

• analytics

• support tools

• subscription management

Features may change at any time without notice.

You must: be at least 18 years old; have the legal capacity to enter binding agreements; and use the platform in compliance with applicable laws and regulations.

By using ElioFlow, you represent and warrant that: you are at least 18 years old; you are legally authorized to enter these Terms; all information you provide is accurate; and you are authorized to act on behalf of any business or organization you represent.

If you use ElioFlow on behalf of a company, organization, or business entity, you represent that you have the authority to bind that entity to these Terms.

ElioFlow reserves the right to suspend or terminate accounts suspected of violating these eligibility requirements.

ElioFlow uses artificial intelligence systems to generate: website layouts; text content; service descriptions; SEO metadata; structured data; and branding suggestions.

Generated content may contain inaccuracies, contain incomplete information, require manual correction, or produce unintended results.

You are solely responsible for reviewing, verifying, editing, and approving all generated content before publication.

ElioFlow does not guarantee: accuracy; legality; originality; SEO rankings; lead generation; conversion performance; or business outcomes.

Use of generated content is entirely at your own risk.

ElioFlow is a software platform for creating, hosting, and managing business websites. ElioFlow is not a marketing agency, lead-generation service, SEO agency, or business-growth consultant.

Nothing on the platform, in generated content, or in our communications shall be interpreted as a promise or guarantee of business results.

ElioFlow does not guarantee, and makes no representation regarding:

• new customers, clients, leads, inquiries, appointments, or bookings

• revenue, sales, profits, or business growth

• website traffic, visibility, impressions, or audience size

• search engine rankings, SEO performance, or local map placement

• conversion rates, form submissions, or marketing performance

• reputation, reviews, ratings, or competitive outcomes

Any examples, templates, suggestions, or marketing language (including phrases such as “get more leads”, “grow your business”, or similar) are illustrative tools only. You must not present ElioFlow or your generated site as offering guaranteed outcomes.

You are solely responsible for all claims, offers, pricing, licenses, certifications, and promises made on your published website. ElioFlow is not liable for misleading, exaggerated, or unlawful marketing made by you or your business.

ElioFlow does not provide: legal advice; accounting advice; regulatory advice; tax advice; or professional business advice.

Any generated content, suggestions, SEO elements, structured data, certifications, licenses, disclaimers, or business-related information provided by the platform are for informational and automation purposes only.

Users are solely responsible for: verifying accuracy; ensuring legal compliance; consulting qualified professionals where necessary; and complying with local laws, licensing requirements, and industry regulations.

License information displayed on your website is entirely your responsibility. ElioFlow does not verify the validity of licenses and is not responsible for inaccurate or outdated information.

Use of generated content is entirely at the user's own risk.

Certain services require paid subscriptions processed by our payment provider (Stripe).

By purchasing a subscription, you authorize recurring charges at the displayed price and interval (monthly or annual) until you cancel.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. Free-trial or promotional offers, if any, are described at checkout and in our Refund Policy.

Taxes may apply where required by law and may be added at checkout.

You are responsible for keeping your payment method valid. Failed payments may result in retry attempts, suspension, loss of access, or termination as described in these Terms.

Cancellation stops future renewals; access generally continues until the end of the current paid period unless otherwise stated. We do not guarantee prorated refunds except where required by law or our Refund Policy.

Prices may change for future billing periods with reasonable notice. Continued use after a price change constitutes acceptance of the new price for subsequent renewals.

Refund eligibility, if any, is governed by our separate Refund Policy.

Self-service refunds may be available for any paid site within seven calendar days of that site’s first payment, as described in the Refund Policy.

Unless otherwise stated: subscription fees are generally non-refundable; partial billing periods are not prorated; domain purchases are non-refundable; and third-party fees are non-refundable.

Chargebacks or fraudulent disputes may result in account suspension or termination.

Users may: connect custom domains; purchase domains through third-party providers; and use ElioFlow subdomains.

Domain registrations are handled through third-party registrars.

ElioFlow does not guarantee: domain availability; uninterrupted DNS operation; registrar uptime; domain retention; or renewal success.

Users are responsible for: maintaining domain ownership; monitoring expiration dates; and complying with registrar policies.

Domain purchases are generally non-refundable.

You are solely responsible for: reviewing website content; verifying contact information; complying with laws and regulations; obtaining licenses or certifications; maintaining backups; and managing customer communications.

You must ensure that all content you publish is accurate, lawful, and appropriate for your industry and jurisdiction.

You agree not to use ElioFlow for any unlawful, harmful, or abusive purpose.

Prohibited uses include, without limitation:

• illegal activities, scams, phishing, or fraud

• malware, spyware, or malicious code

• spam, bulk unsolicited messaging, or deceptive marketing

• impersonation of individuals, businesses, or public figures

• hate speech, harassment, threats, or exploitation

• content that infringes intellectual property or privacy rights

• sale or promotion of illegal goods or services

• circumventing security, rate limits, or abuse controls

We may investigate suspected abuse and may suspend or terminate accounts and remove hosted content immediately, with or without notice, when we believe a violation has occurred or poses risk to ElioFlow, other users, or the public.

We may cooperate with law enforcement and service providers. To report abuse, contact support@elioflow.com with relevant URLs, account details, and evidence.

ElioFlow may provide contact forms, notification emails, or similar tools that deliver messages on behalf of your website.

You are solely responsible for how you use these tools and for compliance with applicable laws, including anti-spam and electronic marketing rules (e.g. CAN-SPAM, CASL, GDPR/ePrivacy where applicable).

You must:

• obtain valid consent before sending marketing or promotional messages

• include accurate sender and business identification where required

• honour unsubscribe or opt-out requests promptly

• not use ElioFlow to send bulk unsolicited email or abusive messages

We may implement technical measures (including rate limits, filtering, CAPTCHA, or temporary blocks) to protect deliverability and prevent abuse. Violations may result in suspension or termination.

ElioFlow is not responsible for spam, complaints, or regulatory penalties arising from messages you or your website visitors initiate through your site.

If your website collects information from visitors, you are solely responsible for: legal compliance; privacy disclosures; customer data handling; and consent requirements.

ElioFlow acts only as a platform provider.

Users retain ownership of: uploaded content; logos; business information; and customer-provided materials.

ElioFlow retains ownership of: platform software; infrastructure; proprietary systems; branding; and internal tooling.

You grant ElioFlow a limited license to host, process, reproduce, and display content solely as necessary to operate the service.

You represent that you have all rights necessary for content you upload or publish, including images, logos, and text.

We respect intellectual property rights and expect users to do the same.

If you believe content hosted on ElioFlow infringes your copyright, send a written notice to support@elioflow.com including:

• identification of the copyrighted work

• identification of the material and its location (URL or project)

• your contact information

• a statement of good-faith belief that use is not authorized

• a statement, under penalty of perjury where applicable, that the information is accurate and you are authorized to act

• your physical or electronic signature

We may remove or disable access to allegedly infringing material and may notify the account holder. Repeat infringers may have accounts terminated.

Users who upload logos, photos, or other media are solely responsible for obtaining licenses and permissions. ElioFlow does not pre-screen all user uploads.

You may not use ElioFlow to impersonate another person, business, or brand, or to create websites that falsely suggest affiliation, endorsement, or authorization by a third party.

You must have the right to use any trade names, logos, trademarks, or branded assets you display.

Third-party trademarks and brand names belong to their respective owners. References on user sites do not imply endorsement by those owners or by ElioFlow.

We may remove content or suspend accounts that appear to infringe trademark rights or facilitate counterfeit, misleading, or fraudulent branding.

ElioFlow may use third-party infrastructure providers.

We do not guarantee: uninterrupted uptime; continuous availability; error-free operation; permanent data retention; or compatibility with all devices or browsers.

Maintenance, outages, infrastructure failures, cyberattacks, or third-party disruptions may occur.

Support availability may vary.

We do not guarantee: response times; issue resolution timelines; or continuous support availability.

Support interactions may be logged for operational and security purposes.

To the maximum extent permitted by law, ElioFlow shall not be liable for: lost profits; lost revenue; lost business opportunities; downtime; SEO performance; search rankings; generated content inaccuracies; customer disputes; data loss; reputational damage; indirect damages; incidental damages; or consequential damages.

Your use of ElioFlow is entirely at your own risk.

If liability cannot legally be excluded, ElioFlow’s total liability shall not exceed the amount paid by you to ElioFlow during the twelve (12) months preceding the claim.

Except as expressly stated in a separate written agreement signed by ElioFlow, the service is provided without warranties of any kind.

Section 4 (Business Results Disclaimer) applies in full. ElioFlow does not guarantee any marketing, SEO, lead-generation, or revenue outcome.

You agree to indemnify and hold harmless ElioFlow, its owners, affiliates, contractors, and providers from claims, damages, liabilities, losses, and expenses arising from: your content; your websites; your business activities; misuse of the platform; legal violations; and customer disputes.

We may suspend or terminate access at any time, with or without notice, including for: abuse; fraud; illegal activity; copyright or trademark complaints; email or spam abuse; excessive resource usage; non-payment; policy violations; and security risks.

Termination may result in: website removal; deletion of hosted content; and account deactivation.

Fees already paid are handled according to our Refund Policy and applicable law.

You may request deletion of your account, projects, or hosted website data by emailing support@elioflow.com from the email associated with your account (or with sufficient verification if no account exists).

We will process verified requests within a reasonable timeframe, subject to legal retention obligations, fraud prevention, billing records, and backup cycles described in our Privacy Policy.

Additional rights for residents of the EEA, UK, Quebec, or other jurisdictions may apply as described in our Privacy Policy.

You are responsible for maintaining independent backups of important business information, media, and website content.

ElioFlow and its infrastructure providers may perform routine operational backups, but we do not guarantee that any backup will be available, complete, or restorable.

ElioFlow is not liable for loss of data, sites, or content caused by: accidental deletion; user error; corruption; infrastructure failures; third-party outages; security incidents; or backup unavailability.

We recommend exporting or saving critical content outside the platform.

ElioFlow relies on third-party providers including:

• Stripe

• Vercel

• Supabase

• Anthropic

• Resend

• DNS providers

• domain registrars

We are not responsible for: outages; policy changes; service interruptions; failures; or actions of third-party providers.

Certain features may be: experimental; beta; or incomplete.

Beta features may: change; malfunction; or be discontinued.

Use of beta functionality is at your own risk.

We may modify, suspend, or discontinue any part of the platform at any time without liability.

These Terms shall be governed by and interpreted under the laws applicable in the Province of Quebec and the laws of Canada applicable therein, without regard to conflict of law principles.

To the maximum extent permitted by law: disputes shall first be attempted informally; users agree to avoid class-action proceedings where permitted; and disputes may be resolved individually.

ElioFlow shall not be liable for delays or failures caused by events beyond reasonable control, including:

• internet outages

• infrastructure failures

• cyberattacks

• natural disasters

• government actions

• labor disputes

• third-party outages

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

These Terms, together with the Privacy Policy and Refund Policy, constitute the complete agreement between you and ElioFlow.

We may update these Terms at any time.

Updated versions become effective upon publication.

Continued use of ElioFlow constitutes acceptance of revised Terms.

By using ElioFlow, creating a project, purchasing a subscription, publishing a website, or accessing any part of the platform, you acknowledge that you have read, understood, and agreed to these Terms of Service.
